Advice regarding the election of Chairman of the Executive Committee


The British Surfing Association's solicitors have advised us that David Weight and Robert Green were properly elected under the constitution at the Executive Committee meeting on 26 April 2007.

We were advised that under the 2007 Articles which are rules or Bye laws of the Association, Rule/Bye Law 6 sets out how Officers of the BSA (including the Chairman) are usually elected. Generally the Chairman is elected by postal ballot (Rule/Bye Law 6.1) which usually requires nominations from members. However, at Rule/Bye Law 6.4, the fourth paragraph down also states that should any office become vacant, the vacancy shall be filled by election by the Executive Committee.

As Dominic Boletta resigned from his post as Chairman (both by telephone and email), the Executive Committee acted constitutionally when it elected the replacement chairmen to fill the vacancy left as a result of Mr Boletta's resignation. Therefore, we are advised that David and Robert were properly elected by the Executive Committee on 26 April 2007.

Since that meeting, David has remained in his post as Chairman and Robert has adopted the role of Vice Chairman.
